Muito se falou sobre preven\u00e7\u00e3o e tratamento do c\u00e2ncer no m\u00eas do Outubro Rosa, mas pouco se esclareceu sobre os direitos e as garantias dos pacientes diagnosticados com c\u00e2ncer de mama ou c\u00f3lo de \u00fatero. E eles s\u00e3o v\u00e1rios: trabalhistas<\/a>, previdenci\u00e1rios <\/a>e tribut\u00e1rios<\/a>.<\/p>\n\n\n\n

A Dra. Cintia Gon\u00e7alves Rafaeli, Advogada, especialista em Direito Previdenci\u00e1rio<\/a>, explica que em alguns casos em que h\u00e1 o acometimento pelo c\u00e2ncer de mama, dever\u00e1 ser analisada a necessidade de afastamento da atividade laboral, pois ser portador da doen\u00e7a n\u00e3o \u00e9 sin\u00f4nimo de estar incapacitado para o trabalho. \u00c9 preciso que haja a conscientiza\u00e7\u00e3o de que, em determinados casos, afastar-se das atividades laborais pode, inclusive, comprometer a manuten\u00e7\u00e3o da sa\u00fade psicol\u00f3gica e emocional, fundamental para a recupera\u00e7\u00e3o”, refor\u00e7a.
Contudo, a decis\u00e3o de afastar-se ou n\u00e3o da atividade depende da avalia\u00e7\u00e3o m\u00e9dica, pois em casos mais graves, o afastamento (tempor\u00e1rio ou n\u00e3o) pode ser necess\u00e1rio, inclusive pelos efeitos colaterais dos medicamentos utilizados na quimioterapia e radioterapia.

Segundo a Dra. Daniele Dur\u00e3o, Advogada, especialista em Direito do Trabalho<\/a>, \u201co portador do c\u00e2ncer precisa estar ciente dos seus direitos trabalhistas, como por exemplo o abono, por parte do empregador de aus\u00eancias parciais para tratamento, devidamente justificadas. 
Importante atentar que as aus\u00eancias decorrentes de tratamento m\u00e9dico n\u00e3o podem ser consideradas faltas ao servi\u00e7o (para fins de desconto no per\u00edodo de f\u00e9rias). Tamb\u00e9m refor\u00e7amos a possibilidade do paciente realizar o saque do FGTS e do PIS, bem como a tramita\u00e7\u00e3o preferencial em processos judiciais e precat\u00f3rios\u201d, destaca a Dra. Daniele.

Outra garantia diz respeito aos rendimentos tribut\u00e1veis, que \u201cem casos de doen\u00e7as como o c\u00e2ncer s\u00e3o considerados isentos, desde que provenientes de aposentadoria, reforma ou pens\u00e3o\u201d, informa o Dr. Jeferson Lu\u00eds Carvalho, um dos dirigentes do Escrit\u00f3rio. \u201cNo \u00e2mbito administrativo a Receita Federal admite prazo para essa isen\u00e7\u00e3o, pois entende que ap\u00f3s o tratamento a pessoa est\u00e1 curada, no entanto, os tribunais regionais v\u00eam se posicionando que no sentido de que a isen\u00e7\u00e3o \u00e9 permanente\u201d, alerta.
